The "Kailash Kher Program" (hereinafter referred to as Program) partnered by Sony Music Entertainment (India) Pvt. Ltd. is open to all persons who register on the web site of ibibo Web Pvt. Ltd. ("Company") or to existing Company registered user, being a resident of India and above 18 years of age ("Participant").
The duration of the Program will be from 1st July 2009 to 15th September 2009 ("term").
To be eligible for the Program, a Participant is required to create his/her profile on ibibo.com and link his/her mobile number to the profile. The Participant will be required to complete all formalities as stated on the website for participation in the Program. The Participant will have the option to listen to the latest song by Kailash Kher – “Na Batati Tuh” (“song”), download the lyrics and choose a convenient time and date for him/her to sing the song from his/her mobile.
The Participant will ensure that he/she is available on the date and time provided for singing the song. In the event that the Participant does not receive the call or the number is not contactable, for any reason, the Company may offer him/her another chance, in its discretion. The Participant may also come back to the Program section, and book another call. The Company will in no manner be liable for any issues on account or arising from the same.
The Participant may share the song sung by him/her with his or her friends, who will vote for his/her song.
At the end of the term, a panel specially constituted by the Company and Sony Music shall choose a maximum of four (4) best singers from amongst the Participants and they will be declared as winners (“Winner(s)”). Winners will get to sing in a studio in Mumbai with Kailash Kher. The best singer from amongst these Winners as chosen by Sony Music will get to record a song with Kailash Kher.
If the Winner(s) are not contactable on his/her email address or no revert from the Winner is received within 3 days after first attempted notification, or if the Winner does not show up at the venue, then the Company reserves the right to select an alternative Winner(s) and the original Winner's entitlement to the prize will lapse.
Winner(s) will be required to submit documentation such as ID, age proof etc. as required by the Company within 5 days from such request being made. If a Winner fails to submit the information/document within the required time, he/she will lose his/her prize.
Schedule, venue of the singing and recording with Kailash Kher shall be contingent on the availability and schedule of Kailash Kher and the same is liable to be changed/re-scheduled accordingly. The Company or Sony Music shall not be held responsible for the same.
Each Winner will be required to adhere to all instructions given by the Company and Sony Music during the singing and recording session in Mumbai.
The Winners will be intimated by e-mail at the address specified by them and will be announced on the website as well. The Company shall not be responsible or liable for non receipt of intimation by e-mail.
Travel, boarding and lodging (if any) for the Winners only shall be arranged by the Company. Choice of hotels, airlines and class shall be at the sole discretion of the Company. Winners should ensure that they reach their respective airports on time failing which the Company shall not be held responsible for re booking or arranging for the travel of the Winner.
Participant(s) will ensure that the song uploaded/sung by them, in no manner alter, tamper or change the lyrics of the original song. In the event of any Participant sings any song other than the song provided in the program or alters/modifies its lyrics, he/she shall be disqualified from this Program and no correspondence regarding the same shall be entertained.
Decision of the Panel shall be final and binding. The panel shall have certain defined parameters like quality, performance, duration etc. basis which they shall choose the final Winners.
The prizes cannot be transferred or exchanged for cash or any other offer.
The Company shall reserve the right to use all data, material etc. received as part of this Program as it may deem fit for its future promotions.
In no event will the prize be transferred to any other person.
Participants consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless the Company from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from their breach/non performance of these terms and conditions.
The Company reserves the right to amend the rules of the Program or extend the period or cancel or discontinue the Program or any part thereof without giving any reasons or prior notice.
We reserve the right to change the prize due to circumstances beyond our control or to offer an alternative of similar value.
No correspondence shall be entertained with regard to the Program.
The employees of Company, Song Music, Service Providers or any associated companies and members of the immediate family of the employees of the Company will not be eligible to participate in the Program.
The laws of India govern the Program all disputes shall be settled within the jurisdiction of Gurgaon only.
The Program will continue to be governed by the terms and condition of the site.
